1. Agreement and eligibility
These Terms of Service (the "Terms") govern access to Klayvora, a service offered by Aurelius RE, LLC. By creating an account, submitting a request, or purchasing a service, you agree to these Terms, the Acceptable Use Policy, Testing Authorization, Refund Policy, and the collection and use practices described in the Privacy Notice.
You must be at least 18 years old and able to bind the business you identify. Klayvora is offered for United States business use and is not intended for personal, family, household, or child-directed use.
2. Accounts and representatives
You must provide accurate information, keep credentials confidential, and promptly update material changes. You are responsible for activity under your account except to the extent caused by Klayvora's breach of these Terms.
If you act for a website owner, employer, client, or agency customer, you represent that you have authority to request and approve the work. One account may organize more than one website, but every request must identify the correct business and authorized representative.
3. Service descriptions
Surface Verification is a $99.99 one-time service for one approved public call, quote, contact, or booking path on one website across one desktop and one mobile configuration. It records the observable result but does not promise receipt in an inbox, CRM, calendar, or other private destination.
Monthly Verification is a $299 recurring monthly plan that includes up to four Surface Verification checks during each paid billing period. Each check remains subject to scope, authorization, scheduling, and evidence boundaries. Unused checks do not roll over unless the order summary expressly says otherwise.
- The final scope, selected offer, price, and exclusions are shown before checkout.
- A completed check includes timestamped evidence, an observed result, a prioritized next action, and one repair retest within the original scope.
- Production repairs, deployments, DNS changes, plugin work, CRM administration, cybersecurity testing, and legal or accessibility certification are excluded unless a separate signed order expressly includes them.
- A result describes a point in time and does not guarantee future availability, conversion, delivery, revenue, or legal compliance.
4. Scope, authorization, and cooperation
Planning, account creation, and scope review do not authorize testing or create a paid order. Public interaction, synthetic submissions, calls, bookings, or destination confirmation occur only within an approved scope and after every applicable authorization gate is complete.
You will provide timely, accurate information and a safe method for identifying synthetic test activity. Klayvora may pause, narrow, or refuse work that appears unauthorized, deceptive, unsafe, illegal, or inconsistent with a third party's rights.
5. Fees, checkout, and recurring billing
Stripe processes checkout. Klayvora does not store full payment-card numbers. Taxes, if any, are shown at checkout. Payment is due only after the request has passed scope review and checkout is unlocked.
The Monthly Verification plan renews automatically each month at the price shown at checkout until cancelled. Before purchase, the checkout and order summary must clearly identify the recurring amount and frequency. You authorize the payment method on file to be charged on each renewal date.
You may cancel future renewal through the customer portal when available or by emailing support@klayvora.io. Cancellation takes effect at the end of the current paid billing period and does not create a prorated refund. Cancellation requests should be submitted before the next renewal date.
6. Delivery and retests
The 24-to-48-hour delivery target begins only after confirmed payment, final scope, required authorization, and receipt of all necessary details. It is an operating target, not a guaranteed deadline when customer delay, third-party systems, unsafe conditions, or events outside reasonable control interfere.
A repair retest covers the same path and approved boundary after the customer reports a repair. New paths, environments, destinations, or materially changed scope require a new check or order.
7. Cancellations, refunds, and billing disputes
All paid services are final and non-refundable except where applicable law requires otherwise, a charge is duplicate or unauthorized, or Klayvora determines it cannot perform the approved service. The Refund Policy provides the controlling details.
Contact support@klayvora.io before initiating a payment dispute so the transaction and evidence can be reviewed. This does not limit any right that cannot legally be waived.
8. Customer materials and test evidence
You retain ownership of materials you provide. You grant Klayvora a limited license to host, process, reproduce, and display those materials only as needed to operate, secure, support, and document the service.
Klayvora owns its software, templates, methods, and general know-how. You may use and share your delivered report for your internal business purposes and with your professional advisers or service providers. You may not remove evidence labels, misrepresent the report as a certification, or resell the report as Klayvora's endorsement of another service.
9. Third-party services
The service depends on third-party hosting, authentication, payment, communication, browser, website, and network providers. Their outages, policy changes, rate limits, and independent acts may affect availability. Klayvora is not responsible for third-party services it does not control, but will use reasonable care in selecting and operating its providers.
10. Acceptable use and suspension
You must follow the Acceptable Use Policy. Klayvora may refuse, pause, or terminate access when reasonably necessary to protect customers, third parties, systems, legal compliance, or the integrity of evidence. When practical, Klayvora will provide notice and an opportunity to correct the issue.
11. Disclaimers
To the maximum extent permitted by law, the service and reports are provided on an as-is and as-available basis. Klayvora disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Klayvora does not warrant uninterrupted operation, a particular conversion result, revenue outcome, defect discovery rate, or that every possible path or failure will be observed.
Reports are operational observations, not legal, tax, accounting, cybersecurity, engineering, insurance, or accessibility advice or certification.
12. Limitation of liability
To the maximum extent permitted by law, neither Klayvora nor Aurelius RE, LLC will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunity arising from the service.
To the maximum extent permitted by law, aggregate liability arising from a claim will not exceed the amount the customer paid for the service giving rise to the claim during the three months before the event. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
13. Indemnity
You will defend and indemnify Klayvora and Aurelius RE, LLC from third-party claims arising from your lack of authority, unlawful instructions, customer materials, misuse of the service, or breach of these Terms, except to the extent caused by Klayvora's own breach, negligence, or willful misconduct. This section applies only to the extent permitted by law.
14. Changes and termination
Klayvora may update these Terms prospectively. Material changes will be posted with a new effective date and, when required, presented for renewed acceptance. Changes do not retroactively alter a completed order unless both parties agree or law requires it.
You may stop using the service at any time. Sections that by their nature should survive termination, including payment obligations, ownership, disclaimers, liability limits, dispute terms, and audit rights, will survive.
15. Governing law and disputes
Unless applicable law requires otherwise, these Terms are governed by New Mexico law, without regard to conflict-of-law principles, and disputes will be brought in the state or federal courts serving Bernalillo County, New Mexico. Nothing in this draft creates a mandatory arbitration or class-action waiver.
